From Thursday (27 April 2023), all Licensing Authorities in England are mandated to use the NR3S under the Taxi and Private Hire (Safety and Road Safety) Vehicle Act 2022. For Wales, Scotland and Northern Ireland, use of the database remains voluntary.
We previously reported that the Government confirmed the NAFN NR3S would be the database to be used for the requirements under the 2022 Act.
NAFN has now released a reminder and guidance for compliance with the 2022 Act:
1. Review the the NAFN Revised National Guidance for Users of NR3S. This document has been updated to include suspensions and a new Joint Data Controller Agreement. This replaces the existing guidance and both the current data processing and sharing agreements, which will continue to be effective for Wales, Scotland and Northern Ireland only.
2. Ensure the details of your organisation's nominated SPoC are up to date on the NAFN system. To verify your nominated NR3S SPoC details, log in to the NAFN website and select Help from the main menu bar. This will open the NAFN Help Guide in a new tab. Enter NR3S in the search field and select the second option in the pick list (see below). If there are any changes required, please send details to NAFN at licencehelp@nafn.gov.uk
IMPORTANT NOTICE: The nominated Single Point of Contact (SPoC) for each licensing authority (in England) is required to sign the new agreement (via the secure NAFN website). Each nominated NR3S SPoC, will be given a 60-day notice period from 27 April 2023 to accept the Joint Data Controller Agreement. If they do not accept during the grace period, the licensing authority will lose access to the register until signed.
